Lutz Partner Rechtsanwälte AG advises various private clients on estate planning. In particular, a marriage and inheritance contract had to be drawn up for a married couple who owns various properties. This marriage and inheritance contract had to contain provisions regarding the division of the inheritance, so that the surviving spouse and the two children will be favored as closely as possible to the statutory inheritance law without selling one of the properties.

Presentation on current issues of tenancy law

On 19 March 2019, the 6th seminar of the Europainstitut on current issues of tenancy law took place. Besides attorneys and lawyers working in the field of tenancy law, participants included real estate managers and representatives of the landlord and tenant association. Staggered sale of a SME

Lutz Partner Rechtsanwälte AG advised an international company on the acquisition of shares of a Swiss SME. Since the shares were to be bought in stages, the buyer had to be granted purchase rights. In this context, the rights and obligations of the buyer and seller had to be regulated for the duration of the right to purchase more shares. The purchase of the first tranche of shares was successfully completed in December 2018.

Money laundering aspects of cryptocurrencies

Over the last four months, our associate Martin Kern conducted five training sessions for the lawyers' and notaries' self-regulatory organization (SRO SAV/SNV)  in Geneva, Lugano, Zurich and Basel on money laundering aspects of cryptocurrencies. The participating lawyers and notaries received a technical introduction into the workings of cryptocurrencies and their handling under anti-money laundering regulations.

SVIT-Commentary on Tenancy Law

Dr. Irene Biber has commented on various provisions of Swiss Tenancy law (see sections 253 seq of the Swiss Code of Obligations) in the new SVIT Commentary on Tenancy Law. The SVIT Commentary on Tenancy Law is a standard commentary in tenancy law regularly used as a reference book by courts and legal experts. The 4^th edition, which was published now, comprises 1354 pages and was written by 12 tenancy law experts with many years of litigation experience.

Carve-out transaction closed

Lutz Partner Rechtsanwälte AG advised a medium-sized specialized retailer in connection with the carve-out of one of its business units. The transaction was successfully concluded in July 2018 by transferring the business unit while maintaining its operations.

Managing assets of an individual under guardianship gives often rise to questions, as there are no specific regulations concerning detailed investment guidelines. Stefanie Wimmer and Rolf Kuhn published an article relating to the topic. The article was published in the June edition of TREX.

Lutz Partner Rechtsanwälte AG features as a "Top Law Firm" in "Tenancy Law" in the ranking of top law firms 2018 published by the Swiss business journal Bilanz and the daily paper Le Temps. The ranking is based on a poll including over 7,000 lawyers, 450 in-house counsels, general counsels of the 500 largest Swiss companies and further clients of law firms.

Removal of defects in a salesroom

Lutz Partner Rechtsanwälte AG represented a well-known company, which is active in the field of e-bike trading, in a proceeding concerning the removal of defects, reduction of rent and deposit. The The claimed defect was constituted by too high room temperatures due to a lack of sun protection and air conditioning. Lutz Partner Rechtsanwälte AG intervened successfully. The tenant was provided with air conditioning by and on account of the landlord. In addition, the tenant received a reduction of its lease rate for the duration of the impairment.

Litigation regarding condominium ownership

Lutz Partner Rechtsanwälte AG defended a condominium owner association against one of the condominium owners at the district court in connection with the distribution of renovation costs. The lawsuit of the owner concerned has dismissed.
